The United States Court of Appeals for the federal circuit has just given notice of its scheduling decision in Apple and Google's cross appeal of Judge Posner's
dismissal of Apple v Motorola. The case was dismissed back in June of 2012 since neither company was able to present compelling proof of damages.
According to the court, the hearing is scheduled for September 11 with responses to the oral arguments due just four days laters. The hearing will cover the original dismissal of the two-way Apple v Motorola case. Motorola originally filed suit over wireless technology while Apple's countersuit was pertaining to touchscreen patents.
The Apple and Motorola trial was originally planned on being tried by Judge Barbara Crabb's court in the district of Wisconsin but was later transferred to Judge Posner's court.
On August 9, Apple will also face Samsung in an unrelated case over the denial of a permanent injunction against multiple Samsung products even though Apple won big in court.
